1. Acceptance of Terms

By accessing or using our AI-powered application building platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Our platform provides AI-powered tools for building web applications, including:

• AI assistants for code generation and application development
• Database integration and management tools
• Frontend and backend code generation
• Application deployment and hosting services
• Team collaboration and organization management

3. User Accounts and Registration

To use certain features of our Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities under your account

4. Acceptable Use Policy

You agree not to use the Service to, and not to permit others (including end users of applications you build or deploy) to:

1. Illegal or Harmful Use Generate, create, or deploy applications for illegal purposes, or in a manner that is harmful, deceptive, or fraudulent.
2. Violation of Laws Violate any applicable laws, regulations, or legal obligations, including data protection and consumer protection laws.
3. Deception, Impersonation, or Fraud Generate, create, or deploy applications that:
   • Impersonate another person, organization, brand, or authority without authorization;
   • Mislead users about the identity, purpose, or legitimacy of the application;
   • Collect credentials, personal data, or sensitive information through deceptive or misleading interfaces, including phishing or credential-harvesting applications.
4. Intellectual Property Infringement Infringe upon or misappropriate the intellectual property or proprietary rights of others.
5. Malicious or Harmful Code Upload, transmit, or deploy malware, viruses, worms, spyware, ransomware, or other harmful or destructive code.
6. Unauthorized Access or Security Interference Attempt to gain unauthorized access to our systems, other users’ accounts, or third-party systems, or to bypass, disable, or interfere with security features, rate limits, or access controls.
7. Service Disruption or Abuse Interfere with, disrupt, or impose an unreasonable or disproportionate load on the Service, servers, or infrastructure, including through automated, abusive, or high-risk usage patterns.
8. Spam and Unsolicited Communications Use the Service to send or facilitate unsolicited bulk messages, spam, or other forms of unauthorized or deceptive communications.
9. Resource Abuse Use the Service for cryptocurrency mining or similar resource-intensive activities not expressly authorized by Build0.

4.1 Public-Facing Applications

Some features of the Service allow you to deploy applications that are accessible to the public (“ Public Apps”). Public Apps carry increased risk and are subject to additional restrictions:

• You may not use Public Apps for phishing, impersonation, fraud, or other deceptive practices.
• Public Apps may not collect sensitive personal data, authentication credentials, or financial information through misleading or ambiguous user interfaces.
• Build0 may apply additional safeguards, limitations, or requirements to Public Apps, including rate limits, feature restrictions, identity verification, or suspension.

Build0 reserves the right to suspend, disable, or remove any Public App that we determine, in our sole discretion, violates this Acceptable Use Policy or poses risk to users, third parties, or the Service.

5. AI-Generated Content

Our Service uses artificial intelligence to generate code and applications. You acknowledge that:

• AI-generated content may not always be accurate or suitable for your purposes
• You are responsible for reviewing and testing all generated code before use
• We do not guarantee the functionality, security, or performance of AI-generated content
• You retain ownership of applications and content you create using our Service

6. Data and Privacy

Your privacy is important to us. Our data practices include:

• We collect and use data as described in our Privacy Policy
• You retain ownership of your application data and source code
• We may use aggregated, anonymized data to improve our Service
• Database connections and credentials are encrypted and stored securely

7. Intellectual Property

The Service and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of applications and content you create. However, you grant us a license to host, display, and operate your applications as necessary to provide the Service.

8. Third-Party Integrations

Our Service may integrate with third-party services (databases, APIs, hosting providers). Your use of these integrations is subject to their respective terms of service and privacy policies.

9. Fees, Billing & Payment

9.1 Subscription & Automatic Renewal

• Access to Build0’s paid plans (Starter, Team, Growth, Scale, Enterprise) is via subscription per month. Subscription fees are billed at the start of each billing cycle automatically.

9.2 AI Build Credits, Executions (XU), and Storage Quotas

• Each plan includes monthly allocations of AI Build Credits, execution units (XU), and built-in DB storage as outlined on our Pricing page.
• AI Build Credits are consumed when using the AI assistant to generate or edit app code. Executions (XU) cover runtime operations (function calls, server time, DB R/W). Storage covers your app data.
• AI credits reset monthly.

9.3 Payment Methods & Failed Payments

• Fees are charged via the payment method on file upon plan activation and renewal.
• If a payment fails, you’ll be notified to update payment info. Unresolved failures may result in temporary or permanent subscription downgrade or access suspension.

9.4 Changes to Pricing & Plans

• We may modify or discontinue features, quotas, or other elements of any subscription tier at any time, and may adjust the prices of subscription plans, overages, or add-ons at our sole discretion.
• If you are on a recurring paid plan, we will provide at least 30 days’ prior notice of any material change in pricing or core plan features before it takes effect on your account.
• Continued use of the Service after such notice constitutes acceptance of the updated pricing or plan terms.

10. Refund Policy

• No refunds for prepaid subscription periods, except in cases of billing errors or as required by law.
• If we charge you in error (e.g., double billing), we will refund the erroneous charge promptly.
• Launchpad builds are complementary and not a separately purchased service. If we determine that a requested Launchpad app is too complex and deliver an MVP, request requirement adjustments, or decline to build it altogether, such determinations do not entitle the customer to a refund or credit.

11. Launchpad White-Glove Setup (Concierge Build)

• Included as a complementary offering only with Growth and Scale plans, one per organization.
• Launchpad is designed to provide customers with a fast, production-ready first app within the limits of their subscription plan.
• If a requested app is, in our reasonable judgment, too complex to be built under Launchpad, we may at our sole discretion:
  1. Deliver a simplified or “MVP” version of the app,
  2. Request that the customer adjust or narrow their requirements, or
  3. Decline to build the app under Launchpad.
• This determination is made entirely at Build0’s discretion, and participation in Launchpad does not guarantee that any requested app will be built in its full or original scope.
• Additional concierge builds may be available separately at custom pricing.

12. Account Changes, Cancellation & Downgrade

• You may upgrade, downgrade, or cancel your subscription anytime through settings.
• Billing cycles run monthly or yearly; cancellations and downgrades take effect at the next renewal—no prorated refunds.
• Downgrading may result in reduced quotas; ensure your usage fits the lower tier to avoid overage fees.

13. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may:

• Perform scheduled maintenance with advance notice
• Temporarily suspend service for security or technical reasons
• Update or modify features of the Service

14. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will cease immediately.

15. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

16. Limitation of Liability

In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

17. Indemnification

You agree to defend, indemnify, and hold us harmless from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your use of the Service or violation of these Terms.

18. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of [Your Jurisdiction].

19. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

21. Severability
